Umapela ang prosekusyon ng International Criminal Court (ICC) sa mga hukom ng Trial Chamber III na ibasura ang mosyon ng kampo ni dating Pangulong Rodrigo Duterte na limitahan sa 10,000 items ang mga ebidensyang ipepresenta laban sa kanya sa paglilitis ng kasong crimes against humanity.
Sa 16-pahinang tugon ng prosekusyon noong October 5, sinabi nito na hindi maaaring magtakda ng arbitraryong limitasyon sa mga ipeprepresentang ebidensya dahil makahahadlang ito sa paghahanap ng katotohanan sa kaso.
Nasa 62,034 items ang kasalukuyang naka-disclose para sa naturang kaso at 44,495 dito ay galing sa iisang dataset na naglalaman ng impormasyon tungkol sa madugong drug war ni Duterte.
Mula sa dataset na ito, 8,812 naman ang kabilang sa kabuuang 19,241 items na listahan ng ebidensya ng prosekusyon.
“It is voluminous because it records the deaths of the thousands of individuals killed by the PNP in anti-illegal drug operations and the deaths of drug personalities while Mr Duterte was President,” saad nito.
Iginiit din ng prosekusyon na paglabag sa kanilang obligasyon ang pagbabawas ng mga ebidensya para lang masunod ang gustong itakdang limit ng kampo ni Duterte.
Ani nito, “Setting an arbitrary cap on the number of documents the Prosecution can disclose would automatically place the Prosecution in violation of its disclosure obligations as it would require the Prosecution to withhold evidence that it considers material to the Defence’s preparation.”
Tinanggihan din umano ng kampo ni Duterte ang mungkahing anim na “agreed facts” ng prosekusyon na magtatanggal sana ng 42,511 items sa case record.
“It is the role of the Defence – not the Prosecution – to review the evidence disclosed to it in order to prepare for trial. The Defence has repeatedly demonstrated its reluctance to begin this work in earnest despite significant assistance from the Prosecution that goes well beyond the scope of its obligations,” dagdag ng prosekusyon.
Magsisimula sa November 30 ngayong taon ang pagdinig sa kasong crimes against humanity ni Duterte kaugnay ng kanyang giyera kontra droga habang nakaupo siya bilang presidente at alkalde ng Davao City.
